Terms of sale

1. Who sells to you and how to contact us
The owner of this site and provider of the services is Hosteate Solutions S.L. (hereinafter, “Hosteate”), with Tax ID (CIF) B16404378 and registered address at Calle Montserrat Roig, 13 - p. 3 pta. 1, 08850 Gavà, Barcelona, Spain. These terms govern the distance purchase of Hosteate's services and apply together with the legal notice and the privacy policy. By completing an order you accept these terms in the version published at that time.
2. What you purchase
Hosteate provides domain registration, web hosting, VPS server and business email services. The specific features of each plan — resources, limits and functionality — are those shown on its pricing page at the time of purchase, and they form part of the contract.
The services are provided on our own infrastructure in European data centres. The location available for each plan is chosen during purchase where the service allows it.
3. Prices and taxes
The prices published on the website do not include taxes. When you purchase, 21 % VAT is added where applicable, and before paying you are shown the full breakdown — taxable base, VAT and total — on the payment screen. The amount charged to you is always that total.
If your company is established outside Spain, the applicable tax may differ (for example, reverse charge on intra-Community transactions with a valid EU VAT number). Write to us before purchasing and we will confirm the treatment that applies to you.
Prices may change, but a price change never applies to a period already paid for. If it affects the renewal of a service you already have, we will notify you sufficiently in advance so that you can decide whether to renew.
4. How to purchase
The process is: you choose the plan, enter your billing details, select the payment method and confirm the order. Before the final step you can review and correct everything you have entered. The language of the contract is Spanish.
Once payment is confirmed we send you an email with the order confirmation and its invoice, and the order is recorded in your customer area, where you can consult it at any time.
5. Payment methods
The payment methods accepted are those shown as active on the payment screen at the time of purchase. Currently these are:
- Card — Visa, Mastercard and Apple Pay (processed by Stripe).
- Cryptocurrencies — Bitcoin, USDT, ETH and more than 50 coins (processed by OxaPay).
- Bank transfer — With your reference, 1 to 2 days. The service is activated once the payment is confirmed in our account.
- Account balance — if it covers the amount, it is deducted directly and no payment gateway is involved.
Hosteate does not store your card details: they are handled directly by the payment provider. Topping up your balance is a payment on account and is used up when you purchase or renew services.
6. Service activation
The service is activated once payment is confirmed. New sign-ups are reviewed before activation, so a short time may pass between payment and go-live; we will let you know by email as soon as the service is ready.
If for any reason we are unable to provide the service purchased, we will tell you and refund the amount paid in full.
7. Term and renewal
Services are purchased for the period stated in their plan and have no minimum term. Unless you tell us otherwise before expiry, the service renews for periods equal to the one purchased, at the price in force at that time.
You can cancel the renewal from your customer area or by writing to us at soporte@hosteate.es. Cancellation takes effect at the end of the period already paid for: the service keeps working until that date.
Non-payment of a renewal may result in the suspension of the service and, after a reasonable period following notice, in its permanent cancellation and the deletion of the hosted data.
8. Right of withdrawal
If you purchase as a consumer (a natural person acting for purposes outside their trade, business or profession), you have 14 calendar days from the conclusion of the contract to withdraw without giving any reason and without penalty, in accordance with Spanish Royal Legislative Decree 1/2007.
To exercise it, you simply need to inform us of your decision by an unequivocal statement to soporte@hosteate.es. We will refund the amount received using the same means of payment and no later than 14 calendar days from when you inform us of your decision.
Exceptions worth knowing before you purchase:
- If you ask us to start providing the service during the withdrawal period and expressly accept this, and you then withdraw, you must pay us the proportion of the service already provided up to the time of your notice.
- The right of withdrawal does not apply to the registration, renewal or transfer of domain names: these are services carried out immediately and irreversibly with the relevant registry, and their cost cannot be recovered by us. When you purchase a domain you expressly accept that performance begins immediately and acknowledge that you lose the right of withdrawal for it.
- The same applies to the hourly rental of GPU servers: it is on-demand computing that starts running immediately as soon as payment is confirmed, on third-party hardware whose cost likewise cannot be recovered by us once purchased. When paying, you expressly indicate that you want the service to start straight away and that, as a result, you lose the right of withdrawal for that rental.
- Nor does it apply to third-party licences already activated or to services customised to your specifications.
If you purchase as a business or professional, the right of withdrawal does not apply to you, without prejudice to whatever is agreed in each case.
9. Invoicing
We issue an invoice for every payment, available in the invoices section of your customer area and also sent by email. The tax details shown on it are those you provided when purchasing: keeping them correct and up to date is your responsibility.
10. Use obligations
Use of the services is subject to the acceptable use terms set out in the legal notice. You are solely responsible for the content you host, its legality and the backups of your information, without prejudice to the backups Hosteate makes as part of the service purchased.
Failure to comply with those terms may result in the suspension or cancellation of the service, on the terms set out there.
11. Availability and liability
We work to keep the services continuously available, but interruptions due to maintenance, technical incidents or force majeure cannot be ruled out. The specific availability terms of each service, where they exist, are set out in the corresponding plan.
Hosteate is liable for damage that is the direct result of a breach attributable to it. Nothing in these terms limits the rights that consumer legislation grants on a mandatory basis.
12. Complaints and dispute resolution
You can send any complaint to soporte@hosteate.es. We undertake to respond as quickly as possible.
If you purchase as a consumer, you also have at your disposal the official complaint forms and the competent consumer protection bodies. These terms are governed by Spanish law and, for any dispute, the parties submit to the courts and tribunals that have jurisdiction under the applicable consumer and user protection legislation.
13. Changes to these terms
We may update these terms to adapt them to legal or service changes. The version applicable to your contract is the one published at the time of purchase; changes affecting services already purchased are notified in advance of their renewal.
